Motion to a judge acting in chambers or duty judge
1) Judge acting in chambers
Day and frequency: every Tuesday.
Wednesdays, Thursdays and Fridays: two weeks per month, on the days when the Superior Court sits.
Time: 8:45 a.m. and 2 p.m.
Courtroom: 2.03 on Tuesdays
2.02 on other days
Other days: an appointment must be made with the assistant to the coordinating judge.
Situations in which the above procedure cannot apply
In situations in which the above procedure cannot apply, in other words in cases in which the judge is absent or unable to act, the provisions of article 39 C.C.P. must be taken into account.
Article 39 C.C.P. reads as follows:
Where in a district there is no judge or the judge is unable to act, the matters provided for in articles 485, 489, 733, 734.0.1, 734.1, 753 and 834.1 may be presented to a judge of another district by any means of communication available to the judge.
2) Duty judge
In cases of urgency, a duty judge is available in Montréal at all times outside normal court hours.
The duty judge can be reached by contacting the security service at the Montréal courthouse (514-393-2819) which will, in turn, contact the duty judge who will then communicate directly with the person making the request.
