Application for postponement
1) Application for postponement made on the day of the hearing
Every application for the postponement of the hearing of a case, whether a case proceeding on its merits or a practice case, is decided by the coordinating judge for the roll of cases proceeding on their merits or, where applicable, the coordinating judge for the roll of practice cases on which the case has been placed.
2) Contested application for postponement made prior to the day of the hearing
Subject to the following, every application for postponement, other than an application referred to in paragraph 1, must be made by motion and is decided by the judge sitting in civil case management, for cases scheduled to proceed on their merits or in the Civil and Administrative Practice Division, or by the judge sitting in family case management, for cases scheduled to proceed in the Family Practice Division.
3) Non-contested application for postponement made prior to the day of the hearing
Every non-contested application for postponement made prior to the day of the hearing must be made in writing and is decided by the coordinating judge for the district of Laval or the judge assigned to replace that judge, who will dispose of it appropriately in light of the circumstances.
